Election Commission Confirms Ranjita Shrestha as Chair of Nagarik Unmukti Party

KATHMANDU – The Election Commission has formally decided that Ranjita Shrestha remains the chairperson of the Nagarik Unmukti Party.

According to Acting Chief Election Commissioner Ram Prasad Bhandari, the decision was made in line with the Political Parties Act and the party’s constitution. “The details submitted by the dissenting faction did not comply with the Act and the statute,” he said.

Earlier, on July 30, a gathering of the party’s founding members had decided to remove Shrestha and appoint Lalbir Chaudhary as the new chairperson. Lalbir is the father of Nagarik Unmukti Party’s founding chair, Resham Chaudhary, and the father-in-law of Shrestha.

With the commission’s decision, Resham Chaudhary’s attempt to replace his wife with his father as party leader has failed.

Action taken against Chairperson Ranjita by Nagarik Unmukti Party: Dismissal from the post

Kathmandu – Ranjita Shrestha, the founding chairperson of the Nagarik Unmukti Party , has finally been removed from her post. The majority of the central members of the Resham faction have passed a proposal to remove Shrestha, who once filed a reply in court stating that her husband, Remesh Chaudhary, who is also the party patron, is not even eligible to be a party member. The governance committee of the Nagarik Unmukti Party held on Tuesday has decided to take action against Chairperson Ranjita Shrestha Chaudhary.

On Sunday, the majority of the central members had decided to ask Chairperson Shrestha Chaudhary for an explanation within 24 hours. The decision to take action was taken after Chairperson Shrestha Chaudhary did not provide an explanation. Even before asking for an explanation, the majority of the central members had given a 24-hour ‘ultimatum’ , to call a central committee meeting to Chairperson Chaudhary, who was dragged into the investigation of the Commission for the Investigation of Abuse of Authority in the land embezzlement case.

Chairperson Chaudhary is involved in the land embezzlement scandal of the litchi garden in Batulechaur, Pokhara. The internal dispute within the party had escalated after she appointed Shiva Bastola as the acting president on Saturday.

Resham Shrestha had formed a party from inside prison while he was in jail and had registered the party with the Election Commission on 19 Paush 2078, making Ranjita the party president. The dispute between Ranjita and Resham Chaudhary, who are related by marriage, had been increasing recently.

Resham Chaudhary’s life imprisonment sentence been waived by the President

May 28, Kathmandu – On the occasion of the Republic Day, President Ramchandra Paudel has pardoned the prison sentence of Resham Chaudhary, who has been serving life imprisonment in Dillibazar prison.

The Council of Ministers had recommended to the President to waive the prison sentences of 19 people, including Chaudhary, who were found guilty by the Supreme Court in the Tikapur mass murder incident.

According to Article 276 of the Constitution of Nepal and Article 159 of the Code of Criminal Procedure 2074, they were pardoned by the President’s Office.

Similarly, according to Article 276 of the Constitution and Article 37 of the Criminal Offenses (Determining and Execution of Punishment) Act and Article 12 of the Senior Citizens Act, the rest of the prison sentences of 482 people have also been waived.

Petition in the Supreme Court against the government’s decision to grant amnesty to Resham Chaudhary

May 28, Kathmandu: Tikapur massacre accused Resham Chaudhary, who was sentenced for life imprisonment by supreme court has been pardoned by the government, on the occasion of Republic Day.

Meanwhile, Sharda Kadayat, the wife of police inspector Keshav Bohra, who was killed in the Tikapur incident, has filed a petition in the Supreme Court against the government’s decision to grant amnesty to Resham Chaudhary.

After the government tried to free Chaudhary, who was found guilty by the court and was serving his prison sentence, Sharda had submitted a petition to the President’s Office and demanded that Chaudhary should not be released from prison.

On Bhadra 7, 2072 BS., during the Tharuhat movement in Tikapur of Kailali, seven security personnel and one minor were killed along with SSP Laxman Neupane of Nepal Police.

Resham Chaudhary’s life sentence upheld by the Supreme Court

May 16,Kathmandu – The Supreme Court has upheld the life imprisonment sentence of Reshlamal Chaudhary, who was sentenced to life imprisonment by the District Court Kailali and the High Court Dipayal for his involvement in the Tikapur incident in Kailali.

With this order of the Supreme Court, Chaudhary has been sentenced to life imprisonment. The joint bench of Supreme Court Justices Anand Mohan Bhattarai and Nahkul Subedi upheld the sentence of life imprisonment imposed on Chaudhary by the District and High Courts.

Sitaram Chaudhary and Gangaram Chaudhary, accused in the same case, have been acquitted. Sitaram and Gangaram were in jail for the term of life imprisonment as per the orders of the District and High Courts. Supreme Court has ordered to release them from prison today.

In the case of Laxman Tharu, As decided by the district court, who has served three years of imprisonment, was sentenced to life imprisonment by the high court. But Laxman tharu will not have to spend more time in prison as the Supreme Court upheld the decision of the district court.

Government’s decision to dismiss the case of the accused in the Tikapur incident

The government has decided to dismiss the case related to the Tikapur incident. The cabinet meeting has decided to amend the law regarding the Tikapur incident and dismiss the case.

The government has also instructed the Ministry of Home Affairs to proceed with the dismissal process of the case related to the Tikapur incident. The decision of the Council of Ministers states, “The Council of Ministers will make a political decision to settle administrative and semi-judicial cases as soon as possible and in the case of cases that conflict with the law, it has been decided to dismiss the case by amending the law.”

On 2072 BS., there was a clash between protesters and the police in Tikapur of Kailali, and 8 people including 5 Nepal Police and 2 armed forces officers and 1 child were killed along with Senior Superintendent of Police Seti Zone SSP Laxman Neupane. In the Tikapur incident, District Court Kailali and High Court Dipayal had sentenced Resham Chaudhary, who is said to be the main accused, to life imprisonment.

Along with this, the government has also decided to proceed with the process of dismissing the cases of Biplav and his party members.

Tharu leaders from congress demand to release Resham Chaudhary

After pressure from the Tharu leaders of the Nepali congress party, Prime Minister Deuba has instructed the Home Minister to proceed with the necessary process regarding the Tikapur incident.

The government has discussed the issue of the Tikapur incident with the officials of the Tharu Kalyankarini Sabha. Home Ministry spokesperson Fanindramani Pokharel said that the implementation of the 6-point agreement with the KP Sharma Oli-led government was discussed. Spokesperson Pokharel said that both sides have done their homework and will hold a meeting again.

Assembly General Minister Premi Lal Chaudhary said that the discussion was focused on the Tikapur incident and the release of prisoners including Resham Chaudhary. Chaudhary says that since the Tikapur incident is a political issue, they have requested to resolve it politically.

Tharu leaders of Congress have analyzed that Resham Chaudhary’s party has become a big factor in the federal and state elections. They believe that if he is released under the leadership of the Congress, it will be beneficial in the elections and the votes of the tharu leaders will be secured.

Former Member of Parliament and Central Member of the Assembly Rukmini Choudhary also said that the current government should implement the agreement which was done during the KP Oli led government.

Tharu leaders from congress had suggested to the Prime Minister that the Tikapur incident should be put aside by following the agreement made by the previous government. Prime Minister Deuba has also assured Tharu leaders that he will solve it through the legal process.
