Court rejects former PM Nepal’s plea for legal representative

Kathmandu – The Special Court has denied for legal representative on behalf to former Prime Minister Madhav Kumar Nepal in the corruption case against him.

Former Prime Minister Nepal had filed an application seeking legal representative on his behalf to appear in court, saying he had to travel to various parts of the country for political events, but the Special Court has denied his request, saying the case is subjected to prison sentence of more than three years.

The bench of Special Court members Tej Narayan Singh Rai and Murari Babu Shrestha denied his request. Last month, the Special Court had ordered former Prime Minister Madhav Kumar Nepal to be released on bail of Rs 3.5 million.

Even if released on bail, he must appear in the Special Court on the date of the case. However, Nepal had sought for legal representative on his behalf to be appeared in court, saying he had to travel to various parts of the country for political activities. If we look at the provisions of Section 89 of the Code of Criminal Procedure Act, 2074, there is no such facility of legal representative for accused in corruption cases.

But Section 95 of the same Act provides for the possibility of seeking the benefit of a legal representative if ‘unforeseen circumstances prevent someone from appearing on the specified date’.

The special court said in its order, ‘It appears that this defendant (Madhav Kumar Nepal) has been charged with an offence punishable by imprisonment for more than three years. Therefore, permission to have a legal representative cannot be granted. Do as per the law.’

On 22 Jestha, 2082, the CIAA had filed a case against former Prime Minister Nepal in the special court, alleging corruption in the decision regarding the permission for the exchange of Patanjali’s land.

In the case filed with a claim of Rs 185.8 million, the special court had applied the legal section that required him to be imprisoned for 8 to 10 years.

The country went towards instability because of UML: Madhav Nepal

Kathmandu: CPN Unified Samajwadi Party President Madhav Kumar Nepal has accused the main opposition party CPN UML of playing a negative role in a very irresponsible manner. Speaking at the party’s second national council meeting that began on Sunday, President Nepal said that UML is determined to destroy the current coalition government.

‘The CPN-UML, which has become the main opposition after being overthrown, is playing a negative role in a very irresponsible manner. There is an audacity to break the current alliance that is being operated by the government in various ways,’ he said. He said that the parties in the opposition have been blocking the House on any issue.

Nepal, who is also a former Prime Minister, said that recently questions are being raised about the stability of the government and political stability in the country. He claimed that due to various opposing forces in the House, instability was being created in the country.

He emphasized that since the coalition government has been formed in the union and all the seven provinces, they should work with understanding among the coalition parties.

He said that the economic crisis and recession that appeared in the country after the Covid-19 is still ongoing. He said, ‘Economic crisis and recession are the same. Although there have been some improvements, the revenue raised has not been enough to cover current expenses. Price rise and inflation have increased. Although it was said to replace imports and promote exports, it has not been done accordingly.’

Immediate unity between leftist is not possible:Madhav Nepal

Chairman of the Unified Socialists Madhav Kumar Nepal has said that immediate unity between leftist is not possible.

Addressing a press meet in Surkhet, he said that the rumors of electoral unity with the UML were baseless and untrue. During his address, Nepal said, “Such rumors have been spread by arrogant and conspirators trying to break the alliance and there is no possibility of any unity or electoral coordination with the CPN-UML.”

Nepal has said that the current Left-Democratic Alliance will be continued till the upcoming state and House of Representatives elections.

Coalition lasts till election: Nepal

Addressing party cadres at Bhaluwang in Dang district on Saturday, CPN (Unified Socialist) Chairman Madhav Kumar Nepal said that the five-party alliance will last till the election.

He said, “A single majority of any party is unlikely to be formed. So, we will form a common candidate in the National Assembly through a five-party alliance. He further added that the allegation of merger with UCPN (Maoist) is not true but there would be unity among the smaller leftist parties in the near future even though there is no immediate possibility of unity with any communist party.

In another context, Nepal said that the MCC should not be passed at its present condition. He said, “We cannot accept any such thing that may open the door for others to interfere in the internal affairs of Nepal. He also said that only issues not related to military and security issues would be acceptable.
