Chitwan- The Chitwan District Court has ordered the release of Rastriya Swatantra Party President Rabi Lamichhane on bail of Rs 5.4 million.
After closed arguments in the Sahara Chitwan cooperative fraud case, the bench of Judge Dayaram Dhakal ordered his release on bail of Rs 5.4 million. Although cases of organized crime have been registered against Rabi in Kaski, Kathmandu and Rupandehi, only a case of fraud has been filed in Chitwan.
The Government Attorney’s Office, Chitwan, has registered a case against Lamichhane and 15 other individuals and six organizations for embezzling funds from the cooperative.
Rabi has been registered only for cooperative fraud, while 12 others have also been registered for organized crime, according to the Government Attorney’s Office. The police investigation report states that 389 million 79 thousand rupees were embezzled from this cooperative.
Chitwan- An order has been issued to send Rastriya Swatantra Party President Rabi Lamichhane, who is accused of fraud in the Sahara Multipurpose Cooperative, to judicial custody.
The bench of District Judge Dayaram Dhakal has handed Lamichhane over to security personnel and sent him to the District Police Office as the hearing was not completed.
After the final hearing, an order will be issued either to send Lamichhane to custody, release him on bail, or release him on a regular date.
District Attorney Rabi Neupane and Assistant Attorney Buddha Bahadur Thapa will argue on behalf of the government. On the other hand, 10 legal practitioners will argue on behalf of the defendant in the case.
A case was registered against Lamichhane and 15 others, including Ram Bahadur Khanal, Rabina Rimal, Bishal Tamang, Navin Achhami, Kabita Tamang, Deepak Lama, Asraf Ali Siddiqui, Bhagwati Bamjan, Laxmi Prasad Poudel, Vigyan Rai, Netrapani Bastola, Shiv Bahadur Gurung and Pragati Shrestha, on charges of embezzling funds from Sahara Multipurpose Cooperative.
Earlier, Lamichhane has been released on bail by the Kaski, Rupandehi and Kathmandu District Courts in the case of embezzlement of the cooperative’s funds.
Kathmandu – President of the Rastriya swatantra party Rabi Lamichhane has reached the Parliament Secretariat with a petition to lift his suspension from the post of MP.
Lamichhane is expected to meet Speaker Devraj Ghimire and request his suspension lifting, claiming that the suspension is illegal and against the rules of the House of Representatives.
The Parliament Secretariat suspended Lamichhane from his post as MP on Poush 8 after a case of money laundering was registered along with cooperative fraud.
RSP has already decided to protest the suspension of his post as MP in the House of Representatives meeting to be held today, saying that it was politically motivated.
Pokhara – Rastriya Swatantra Party President Rabi Lamichhane has approached the Pokhara High Court against the Kaski District Court’s decision to release Rabi on a bail of Rs 6.5 million on Poush 10, saying he is not satisfied with the court’s order in the Surya Darshan Cooperative fraud case in Pokhara.
On the one hand, the Office of the High Government Attorney has filed a petition in the Pokhara High Court against the District Court’s order to release Rabi on bail, demanding that Rabi be kept in custody and investigated, while on the other hand, Lamichhane has approached the High Court saying he is not satisfied with the District Court’s order.

Kathmandu – Rastriya Swatantra Party President Rabi Lamichhane has been released from the Rupandehi District Court in the cooperative fraud, organized crime and money laundering case after posting a bail of Rs 10 million. Along with the order to release him on bail, the Rupandehi District Court has ordered to freeze the assets of Lamichhane and others who have been made defendants in the Supreme Cooperative Fraud case.
After the closed argument, the bench of Judge Pralhad Kumar Yogi ordered to freeze the assets in the order seeking a bail of Rs 10 million from Lamichhane.
The order states, ‘The assets in the names of the defendants mentioned in the indictment shall be frozen in their current status so that they cannot be transferred in any way in accordance with Rule 92 of the Civil Criminal Procedure Rules, 2075 BS, and a letter shall be sent to the concerned Land Revenue Offices requesting them to send a reply.’
Rupandehi — Rastriya Swatantra Party President Rabi Lamichhane has been released on bail of Rs 10 million in the cooperative fraud, organized crime and money laundering case at the Rupandehi District Court.
After the arguments of the defense lawyer, the counter arguments of the public prosecutor and the government lawyer on Sunday, Rupandehi District Court Judge Pralhad Kumar Yogi ordered the bail of Rs 10 million.
The District Government Attorney’s Office had registered a case against 22 people, including Lamichhane, in the Rupandehi District Court on Magh 22 for Supreme cooperative fraud and organized crime.
Lamichhane, who was arrested in connection with the investigation into the Surya Darshan Cooperative fraud case in Pokhara, was released on bail of Rs 6.5 million by the Kaski District Court on and on bail of Rs 6 million by the Kathmandu District Court in the Swarna Lakshmi Cooperative fraud case .
Butwal- The District Court, Rupandehi, has also ordered the release of Rabi Lamichhane on bail on charges of cooperative fraud.
The court has ordered the release of Lamichhane, who is accused of being involved in irregularities in the money deposited by savers in the Supreme Cooperative in Butwal, on a bail of Rs 10 million.
In the detention argument before Judge Pralhad Kumar Yogi, government lawyers had argued that Lamichhane should be sent to detention, saying that the justice of the victims would be affected if he remain outside. However, lawyers for Lamichhane’s side had argued that the state is taking revenge trying to put him in the custody.
Lamichhane had earlier been ordered to be released on a bail of Rs 6.5 million in the Surya Darshan Cooperative case in Pokhara and on a bail of Rs 6 million in the Kathmandu District Court in the Swarna Lakshmi Cooperative case in Kalimati.
A case was registered against Rabi in the District Court, Rupandehi based on the investigation conducted by the Area Police Office, Butwal.
The government prosecutor had claimed in the indictment that his involvement in the cooperative fraud was confirmed based on the check signed by Lamichhane used to pay the amount to the cooperative, the payment made to Mrs. Nikita Poudel, and the transfer of ownership of the company based on false statements.
Kaski- Rabi Lamichhane, president of the Rastriya swatantra Party and former managing director of Gorkha Media Network Pvt. Ltd., who was arrested in the Suryadarshan cooperative fraud case, has been released. He was released on Thursday evening after posting a bail of 6.5 million after the order of the District Court, Kaski.
After the detention hearing, the bench of Judge Nitij Rai had sought bail from Lamichhane. Lamichhane, who was arrested on cooperative fraud case was released after 84 days.
Even though the kaski court released him on bail, the Kathmandu District Court has already issued an arrest warrant against him.
An arrest warrant has been issued against Lamichhane in the case of embezzlement of billions of rupees from savers from the Swarnalakshmi cooperative operating in Kathmandu Metropolitan City-14. According to police sources, Lamichhane has been released as he will appear in Kathmandu District Court in person.
Pokhara – The District Court, Kaski, has ordered the release of Rastriya Swatantra Party (RSWP) President and former Deputy Prime Minister and Home Minister Rabi Lamichhane on bail of Rs 6.5 million in the case of embezzlement of savings of Pokhara’s Surya Darshan Cooperative.
The bench of Kaski District Court Judge Nitij Rai ordered the release of Lamichhane on bail.
The District Public Prosecutor’s Office had filed a case against 44 people, including Lamichhane on charges of embezzlement of cooperative funds. Lamichhane is also facing charges of cooperative fraud, organized crime and money laundering.
The Public Prosecutor’s Office has so far filed cases against 63 people in the District Court, Kaski, in the Surya Darshan Cooperative fraud case. The District Public Prosecutor’s Office has stated that cases have also been filed against 19 people, including Lamichhane, for organized crime.
Kaski Police had advised the District Attorney’s Office, Kaski, to recover Rs 1.5 billion from 51 people, including Lamichhane, and to prosecute them for cooperative fraud, organized crime, and money laundering. In the case of Lamichhane, the police investigation report recommends 4 to 6 years in prison for cooperative fraud, an additional 50 percent punishment for organized crime, and 2 to 15 years in prison for money laundering, and a fine of double the amount. A charge sheet has been filed against Lamichhane, demanding a collective amount of Rs 16.265 million under cooperative fraud, an individual amount of Rs 17.5 million, and a total of Rs 278.944 million in money laundering.
Kathmandu: The police have filed a report with the District Attorney’s Office demanding punishment for cooperative fraud and organized crime against 44 people, including Rastriya Swatantra party President Rabi Lamichhane, on charges of embezzlement of funds from the Swarnalakshmi Multipurpose Cooperative Organization in Kalimati.
In the report with opinion submitted by the police to the Office of the Government Attorney, the police have demanded a compensation of Rs 1.19 billion 49 million 21 thousand 270 including the amount embezzled from the cooperative.
Police have stated that 44 people including Lamichhane, GB Rai, former DIG Chhabilal Joshi, GB’s brother-in-law Deepak Lama, treasurer Kumar Ramtel and manager Navin Achhami involved in embezzlement of funds from Swarnalakshmi Cooperative have been filed as defendants.
690 people have filed 93 reports in the cooperative fraud case. Police investigations have revealed that Rs 2.65 billion 95 million 59 thousand 58 were misappropriated from 5,669 savers in the cooperative.
Similarly, Sabina Ale Magar, wife of student leader Dipesh Pun, has been made a defendant in the case. Police have also made a dozen other organizations that took loans from the cooperative as defendants. Police investigations have revealed that Rs 648 million 338 thousand 465 were transacted in Gorkha Media Network Pvt. Ltd. from the cooperative where the money was misappropriated.
Similarly, in the Surya Darshan cooperative fraud case in Pokhara, closed arguments are ongoing in the Kaski District Court in the case including former Managing Director of Gorkha Media Network Pvt. Ltd. Lamichhane, former Vice President of Gorkha Media and former DIG Chhabilal Joshi. Kaski Police is of the opinion that they should be prosecuted for cooperative fraud, organized crime and money laundering.
Kathmandu – The MP post of Rastriya Swatantra Party President and former Home Minister Rabi Lamichhane is set to be suspended. Lamichhane’s MP post will be automatically suspended after a case filed in court under the Prevention of Money Laundering Act.
District Attorney Kamala Kafle of the District Government Attorney’s Office, Kaski, said that Lamichhane’s post will be suspended as per the act until the final decision of the case is made.
According to Section 27 of the Prevention of Money Laundering Act, an employee, officer or civil servant is automatically considered suspended until the final decision of the case is made. She also said that preparations are underway to send a letter to the Parliament Secretariat regarding the filing of a case in court.
Section 27 of the Prevention of Money Laundering Act provides for automatic suspension. “If any official or employee of an organization established under the prevailing law or any civil servant is detained under this Act, such employee, official or civil servant shall be deemed to have been automatically suspended for the period of such detention and until the case is resolved.”
The District Attorney’s Office, Kaski, filed a case against 31 people, including Lamichhane, in the District Court, Kaski on Sunday. Three cases have been registered against them in the Surya Darshan Cooperative fraud case in Pokhara. A case of cooperative fraud, organized crime and money laundering have been registered against Lamichhane, former DIG Chhabilal Joshi, Leela Pachai, Ram Bahadur Khanal and Krishna Bahadur Gurung. According to the District Court, Kaski, a case has also been filed against eight companies. Similarly, the Office of the Public Prosecutor has suggested that the assets of 5 people should be confiscated.

The police investigation report states that Lamichhane will be sentenced to 4 to 6 years in prison for cooperative fraud, an additional 50 percent punishment for organized crime, and 2 to 15 years in prison and a fine for money laundering.
The District Attorney’s Office filed a supplementary charge sheet in court on Friday, adding additional offenses and amounts against 19 people accused of defrauding cooperatives last year. A case has been filed against the main mastermind of the cooperative fraud, GB Rai, for organized crime, money laundering and violations of the Rastra Bank Act.
Pokhara – Rastriya Swatantra Party President Rabi Lamichhane will be taken to the Kaski District Court today for case registration in the Cooperative Fraud case in Pokhara.

In the case of Lamichhane, the police investigation report states that 4 to 6 years of imprisonment should be imposed for cooperative fraud, an additional 50 percent punishment for organized crime and 2 to 15 years of imprisonment and a double fine of the amount imposed for money laundering.

KATHMANDU – The Parliamentary Inquiry Special Committee formed to investigate the misappropriation of the savings of cooperatives has instructed the Home Minister to bring those involved in cooperative fraud to Nepal.
In discussions with the Home Minister, Home Secretary, and Chief of Police, the committee found that 18 people involved in cooperative fraud were outside the country and instructed them to bring them to Nepal.
It is said that the committee has also provided the names of those outside the country to the Home Minister.
Kathmandu – RSP has removed Dr. Mukul Dhakal from his position as General Secretary and Spokesperson.The meeting of the central committee of the RSP held today has removed Dhakal from other responsibilities of the party so that he remains only an ordinary member of the RSP.
After discussing the report of the Disciplinary Commission regarding Dhakal, the Central Committee decided to remove him from other responsibilities so that only ordinary members remain.
Dhakal was removed from the position on charges of incompetent, undisciplined, apolitical, indecent, chaotic behavior and violation of discipline in running the party.
Due to the dispute that started within the party regarding Dhakal’s review trip report, Dhakal was punished by the party, but the party did not take ownership of his report. An official of the RSP said that the report was submitted to the party and made public before the discussion.
On the other hand, Mukal Dhakal, who has been sacked from the position, said that he was expelled not from the party but from the club of Chairman Lamichhane.
Kaski – A complaint has been lodged at District Police Office Kaski against three people including Rabi Lamichhane, president of Rastriya Swatantra Party and Dipesh Pun,son of former Vice President Nanda Bahadur Pun in the case of co-operative fraud.
The depositors of Pokhara’s Suryadarshan Savings and Loan Cooperative have filed a complaint against Rabi Lamichhane, president of Rastriya Swatantra Party , Dipesh Pun, the son of former Vice President Nanda Bahadur Pun, Gyan Bahadur Bamjan, the former president of the cooperative, and various 15 companies.
As the District Police Office Kaski has already registered a complaint on the same issue, District police now has said that the complaint will be investigated as a supplementary application.
Earlier, the International Criminal Police Organization (Interpol) has issued a diffusion notice against three people on charges of cooperative fraud. A notice was issued against Suryadarshan Cooperative founder president Gitendrababu (GB) Rai, current president Than Bahadur Budhamgar and former president Bhupendra Rai.
A complaint was lodged at the District Police Office Kaski on the allegation that 19 people including Rai had embezzled more than one billion from the cooperative and the case is now under investigation.
Kathmandu – A diffusion notice has been issued requesting Interpol’s help in arresting GB Rai, who has been charged of co-operative fraud.
District Police Office Kaski had earlier requested the Police Head Office to issue a diffusion notice in the case of fraud in Suryadarshan Cooperative. In response, Central Police Spokesperson DIG Bhim Prasad Dhakal informed that Interpol’s National Central Bureau Kathmandu has requested the Secretary General of Interpol to issue the notice.
The Kaski District Court earlier ordered the arrest of treasurer Kumar Ramtel on charges of misappropriation of depositors’ money. In the same incident, Vice President Kailash Kumar Darlami, member Shiv Bahadur Gurung and Bhagishwar Aryal were also arrested and are currently being detained and investigated, according to the Kaski Police.
An arrest warrant has been issued against 19 people including JB Rai in the Suryadarshan Cooperative fraud case. 15 of them are absconding now.
In the complaint, it is alleged that the employees of Suryadarshan embezzled 1.12 billion rupees from the depositors. Under the Cooperative Act, they can be jailed for 8 to 10 years and fined.
According to the police report, the GB Rai group embezzled the funds of Suryadarshan by creating fake shareholders and various companies. The police have concluded that the directors and officials of the cooperative opened fake share member accounts and misappropriated the funds without placing the assets in the name of the cooperative or individuals.
April 23, Chitwan- A complaint has been lodged at the office of the Chief Electoral Officer against Rabi Lamichhane as Rastriya Swatantra Party violated the election code of conduct during the ongoing by-elections in Chitwan constituency 2.
Nepali Congress candidate Jit Narayan Shrestha’s representative Dhurvaraj Pokharel filed a complaint at the office of the Chief Electoral Officer, claiming that RSP President Lamichhane influenced the voters by asking for votes through social media and online during the voting period.
The polling was disrupted for about 2 hours after the RSP activists thronged the polling station shouting slogans. Voting started after RSP apologized for violating the code of conduct and reached a four-point agreement.
